The Andalusia City Council on Tuesday approved unanimously the revocation of Mellow Haze’s business permit. Mellow Haze, which was licensed to sell tobacco products by the State of Alabama and held an official city retail license.
Mellow Haze was closed and its license was suspended following the execution of a search warrant in the area on Oct. 12. Items seized at the scene were sent to the Alabama Department of Forensic Sciences where test results on some items were returned as ‘marijuana-controlled substance.’ Police said the search warrant was obtained upon receiving reports of illegal activity.
The council called a public meeting on the end of November. 7 meeting regarding the business license. Representatives from Mellow Haze were given two weeks to submit details that proved the product being offered was not unlawful. According to the mayor Earl Johnson, no information was provided.
Lawyers representing the company said that the product were legal in the state of Texas and had a THC threshold at .3 per cent or less.
“We have an original report of the Alabama Department of Forensic Science in Montgomery which states that the substance found at the business’s location was tested and proved to contain marijuana. It is which is a controlled substance. The question that was put to the attorney of the businesswas, what is the reason why the report from the state is wrong? We’re at the same point as we were two weeks before,” Johnson said.
In the event that no further details were provided in the report, Councilman Terry Powell made a motion to revoke the license. it was voted down by a majority vote.
Mellow Haze has remained closed following the it was notified of the warrant.
In another action:
- The council conducted an initial reading on an exchange of property in conjunction with Robert Bishop. The council held a first reading regarding the issue and involved the city offering the Bishop the property located in Sixth Avenue in exchange for the property located situated on Coleman Avenue, which is required for the current Andalusia High School-Coleman Avenue pedestrian sidewalk project. Following the first reading on Tuesday council members could vote to decide to approve the exchange at the next council meeting.
- The council approved two new members of the board of library. The council appointed Laura Carpenter and added Paul Ugstad as a new member of the board.
- The council voted to approve the request for reimbursement for reimbursement from CDG Engineering for work performed on the Prestwood building project. The amount of $274,340 was made from the proceeds of bonds.
Next city council meeting is scheduled to be held on Tuesday, December. 5 the workshop will begin with a 5:30 p.m. Then, the regular meeting starting at 6 p.m. The public is welcome to attend.
