Washington D.C. –U.S. Senator Katie Britt (R-Ala.) recently joined U.S. Senators Mike Lee (R-Utah), Bob Menendez (D-N.J.) and Congressmen Adrian Smith (NE-03) and Don Beyer (VA-08) to introduce the Formula 3.0 Act,legislation which would permanently halt the tariffs on infant formula from certain countries, which would ensure accessibility and affordability for American families.

In 2022 households all over all across the U.S. struggled to find formula to feed their children following the Food and Drug Administration (FDA) temporarily shut down one of two producers of the country’s formula. In the midst of the crisis, Congress passed legislation to temporarily lift tariffs on imports of infant formula from other countries and brought much-needed supply to the market. The suspension of tariffs ended in January 2023.

With the threat of another imminent shortage, and the possibility of price increases and rising costs, it is proposed that the Formula 3.0 Act will reinstate tariff suspensions and extend them for a period of time as a way to ensure parents are always able to access affordable infant formula that is in line with the FDA’s requirements.
