MESA, AZ — Mesa, Arizona has reached an $8 million settlement for Laney Sweet, Laney Shaver’s widow and his two children.

Shaver was shot to death in 2016 by Phillip Brailsford, a Mesa Police Officer.

After a call about someone pointing a gun from a window, officers were initially called to a hotel.

Brailsford held Shaver at gunpoint and ordered him to crawl forward on the hotel’s hallway floor.

Brailsford was convicted of murder after being tried. Brailsford was initially fired from the force, but he was allowed to retire with an accidental disability pension.

Brailsford claimed that he fired his gun when Shaver reached towards his back to pull out a handgun. Brailsford claimed he was afraid for the safety and well-being of the officers and a female in the hallway.

Later, police determined that Shaver wasn’t armed at the time he was shot to death.

During the trial, the detective who investigated the shooting said that Shaver’s movements were similar to reaching for a gun. However, he also stated that it looked like Shaver was pulling on his loose-fitting basketball pants as he crawled. He noted that he didn’t see anything that would prevent officers from handcuffing Shaver while he was lying on the ground.

After the settlement was reached, the children of Sweet and Shaver released a statement:

“Daniel Shaver was a loving, caring husband and father who will be remembered for his kindness and compassion. His spirit was a source of light and love that he gave to all those who were around him during his short life. His children and wife were provided stability, security, and prosperity while he was here. He was a practical, caring person who saw the big picture in every situation. His charm and good nature were a testament to his good will.

He is missed by his beloved wife and children every minute of every day. They will never forget Daniel’s loving legacy nor the precious memories of their time with him. A life cut short by injustice cannot be described in words, and money will not erase the traumas that took Daniel from his family forever.

While this settlement helps Daniel’s widow and children with the financial stability to move forward, it does not erase the cruelty of his killing, or the malicious campaign by the Mesa Police Department–orchestrated and implemented by their attorneys for over 6 years of needless, malevolent scorched-earth litigation. The blatant lack accountability of all parties since Daniel’s death on the night of his death is an irredeemable problem in the criminal justice system. This settlement will not address it.

The injustice and failure of Daniel Shaver’s murder and the resulting sham trial for his criminal charges, which made mockery of Justice’s concept of Justice, resulted in no conviction. This settlement continues to be shadowed. We call on the Department of Justice, as this chapter is closing, to quickly continue its investigation and make public the federal criminal convictions of the officers involved. This will bring justice where Arizona has failed. “
